Have a plan to tackle backlog of cases: CJI designate Ranjan Gogoi

Justice Ranjan Gogoi who is set to be the Chief Justice of India (CJI) next week have expressed deep concerns about the massive backlog of cases. Speaking at a session on “Role of Bar and Bench in Social Engineering,” hosted by the Youth Bar Association of India. CJI designate said that pendency of cases is bringing a disrepute to the system. However, Justice Gogoi said that he has a plan to combat this problem. 

He was quoted by Bar and Bench as saying, "  Pendency is bringing a lot of disrepute. In fact if I may say so, it has the potential of making the system irrelevant. The accused in a criminal case is getting a hearing after he has served out the sentence. The parties in a civil proceeding are getting their judgments in the second or third generation".

However, he promised a way out saying, "This is a problem. I would request each of you to kindly give a thought to this and see how you can overcome this difficulty. I don’t think the task is really …. I have a plan and will unfold it and you are welcome to take part in that and participate in the process.”

According to reports, currently there are 33 million pending cases and 90% of them are in lower courts. However, even the Supreme  Court has unresolved nearly 57,000 cases.  Successive CJIs have sought to curb this festering problem. CJI designate Gogoi made it clear that this will be top of his agenda. 

He also said that courts should try to provide social justice to people from all walks of society. He said that the legal community including lawyers and judges have to ensure that 'human rights, political rights, social rights' of Indians are protected.
